How would you improve?
Observations The process covering the various forms of change is complex when reading as a whole and thus difficult to assess. The references to Tiers, Steps and Stages which are then subject to sub sections and reference to appendices exacerbate the complexity and offer a myriad of options for managing the process.
General observations
Please Note responses to Q2 – Q7 (inclusive) have been made and should be assessed taking into account the difficulties we have expressed in answer to Q1. NCS reserve the right to make changes to the answers and make any relevant observations in the future which may not fully reflect our original responses. Such changes may arise if we become aware we have misunderstood any aspect of this complex process and need to amend our assessment held at the time of this consultation. NCS support the principle of a formal procedure. However the proposed protocol will not amend the current situation where the CAA makes all the decisions. The proposal in fact enshrines the CAA monopoly giving them responsibility for at each stage as well as the final decision. We are disappointed the opportunity to introduce an independent appeal system is disregarded. The justification for this decision that only the CAA have expertise is concerning. ICCAN is promoted as being independent but examination of the arrangements for its operation suggests it will not achieve such independence it is unlikely to give confidence to the public. The lack of power afforded to ICCAN will only reinforce a lack of public confidence. The CAA “monopoly” is exacerbated by the prevailing culture of the CAA being solely regulatory there being a complete lack of flexibility to react to genuine and identifiable adverse impacts raised by the public. A number of changes in Gatwick departure routes demonstrate the point we draw your attention to our and other submissions on route 3. Gatwick authorities have (finally) acknowledged the problem and are endeavouring to find a solution the CAA simply dismiss the issue on the basis of “compliance”. Our concerns are recorded in our response to the Dft consultation on air space. The three categories being assessed is a subjective test. It is does not invite a critical view of the actual procedure. We wish to make it clear that analysis of our grades must not be interpreted or used to infer support for the actual process.

How to improve
Observations We have previously observed on the lack of flexibility the CAA give to decision making relying on a regulatory function. Simply expressed if the box can be ticked approval is given. The methodology expressed in paras. 121 – 127 confirm the point. Current metrics relied on are inappropriate and heavily weighted to the air industry. Ambiguity arises where although conformity may be apparent leading to CAA approval. Adverse impacts arise for stakeholders. We repeat our reference to the issue of departure route 3 , Gatwick Airport. The CAA PIR approved changes which increased the level impact (of R3 changes) on significant numbers of residents by introducing overflying of settlements. The CAA continue to dismiss “appeals” on the basis of conformity and disregard the additional impact.

We support the concept of a 3rd party facilitator. We provide this response as in relation to the decision to dismiss an appeals procedure the CAA expressed the opinion that the CAA is the sole organisation with the expertise to so adjudicate. The facilitator should have a level of expertise and we are therefore unclear how the facilitator will operate meaningfully in the absence of expertise. We are also unclear when and who can exercise the option to use the facilitator. Clarity on the constitution and guidance of the 3rd party facilitator should be provided.

12. In paragraphs 177 and C34-C36, and Table C2, we discuss the categorisation of consultation responses. The sponsor is required to sort consultation responses into two categories: i) those responses that have the potential to impact on the proposal because they include new information or ideas that the sponsor believes could lead to an adaptation in a lead design option or a new design option, and ii) those that do not. Tier 1a: Options appraisal

Tier 1a: Safety information

14. At each stage in the airspace change process that an options appraisal takes place, the sponsor will be required to submit a safety assessment. The sponsor will be required to provide a plain English summary of the safety assessment and the CAA will provide a plain English summary of its review (i.e. of the Letter of Acceptance, which forms the CAA’s review of the safety assessment) when it makes a decision. These documents will be available on the portal.   Do you have any views on specific information that should be included and/or excluded from the plain English summary of the sponsor’s safety assessment and the CAA’s review?

Tier 1: Spaceflights

17. On 21 February 2017 the Government published the Draft Spaceflight Bill. As the foreword to the draft Bill sets out, “This legislation will see the Department for Transport and the Department for Business, Energy and Industrial Strategy, the UK Space Agency, the Civil Aviation Authority and the Health and Safety Executive working together to regulate and oversee commercial spaceflight operations in the UK.” Do you have any views on whether this process could be used or adapted to suit future airspace change proposals to enable spaceflights, as anticipated in the Draft Spaceflight Bill?

Tier 2: Permanent and planned redistribution

The Government proposals talk about a Tier 2 change as one which is likely to alter traffic patterns below 7,000 feet over a populated area and which therefore could have a potential noise impact for those on the ground. If Tier 3 changes run smoothly in practice there’s no necessity to be prescriptive. This can only be established by experience and analysis to such change events. The CAA should consider including the option to visit the issue when data is available and react accordingly.
