How would you improve?
The consultation should have consisted of an overview of the entire process written in Plain English with a supporting Procedures Manual containing the detail. The actual document is neither a clear explanation nor a detailed set of processes.
General observations
• The consultation is flawed as the document is lengthy and technical in wording thereby limiting those able and willing to respond; • There is a lack of transparency in the proposed process as to the criteria the CAA will use to assess proposals at each stage; • The proposals would result in a lengthy process (2 to 3 years) which could be to the detriment of both impacted communities and sponsors e.g. airports looking to implement changes. However, there does need to be time for adequate consultation, so on balance I recommend any response comments, but does not express a view; • Options to reverse changes, in the event that Stage 7 (Operational Review) finds the changes have not be successful, should be included in the airspace change process so as to allow timely reversal;

• There needs to be a clear requirement in the process to show that full environmental, including noise, issues have been considered, measured, modelled and assessed and that the resulting proposals have clearly taken this into account with mitigation strategies if appropriate.

• Where a change in airspace is proposed the consultation must be meaningful and designed to allow as wide as possible engagement i.e. not be limited to online responses to highly technical documents. The sponsor must demonstrate that they have actively engaged with the impacted communities and that options have been presented as part of the consultation;

• If a sponsor does not follow ICCAN (Independent Commission on Civil Aviation Noise) guidance, permission to an airspace change should not be given except in very exceptional circumstances and the CAA should set out clearly why they consider such circumstances to exist. The Secretary of State should be consulted in such circumstances; and • There should be greater consideration of the impact on communities in changes in traffic volumes. Where an airspace change is being considered, in conjunction with changes in volumes, the combined impact on communities should be clearly identified at each stage of the process. • There needs to be a clear requirement in the process to show that full environmental, including noise, issues have been considered, measured, modelled and assessed and that the resulting proposals have clearly taken this into account with mitigation strategies if appropriate.

• There should be an ‘ombudsman’ function in the process such that proposals could be ‘called in’ and reassessed to ensure they have interpreted all points correctly and have taken the best solution from an independent standpoint. If this is not proven the proposals should be rejected back to the sponsor for reassessment and reworking if appropriate.

Tier 1a: Evidence of engagement

At certain stages in the process (starting with the development of design principles at Step 1b) the CAA will look for evidence of a two-way conversation to see that the sponsor has adequately engaged stakeholders. In paragraph C9 the CAA describes the evidence that we will look for as "detail of what sponsors have been told by their audiences; how they responded to this feedback; and how it has affected the proposals they are bringing forward".    Has the CAA adequately detailed what we would expect to see to know that a two-way conversation has taken place?

Tier 2: Permanent and planned redistribution

18. The Government proposals talk about a Tier 2 change as one which is likely to alter traffic patterns below 7,000 feet over a populated area and which therefore could have a potential noise impact for those on the ground. The key requirement is that the air navigation service provider must demonstrate that it has assessed the noise impact of the proposed change and engaged with affected communities as appropriate.
